These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. Purchase of products

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website. All payments are transacted though a secure third party website. We do not have access to your payment details.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

You place the order for your products on the Website by pressing the "Place Order and Proceed to Payment" button at the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website and that of our third party payment processor.

We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from Tailor Mouse Ltd.

As your product is shipped from our warehouse we will send you a despatch confirmation email.

Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being unavailable from stock. Products with quantity discount pricing or bulk buy items are available to back order. If we do not have sufficient stock to fulfil your order we will ship the available items and include a notification of part shipment document with your order, detailing any shortages and when you can expect to receive the balance of your order. Unless otherwise stated all other products are only available from stock. If you place an order for more than the available stock you will be notified of this when the available items are added to your basket. In the event that stock levels are incorrect at the time of ordering we will notify you by email of any discrepancies prior to shipping your order.
  • Our inability to obtain authorisation for your payment.
  • The identification of a pricing or product description error.
  • You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

The contract will be concluded in English.

Consumer Contracts Regulations 2013

This legislation offers you the following cancellation rights when you buy online or by phone:

You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

Your right to return products does not apply to goods made to your specification, personalised or made-to-measure products, this includes fabrics, trimmings, and other items cut to size.

If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

Description of products and colour accuracy

Each Product purchased is sold subject to its Product Description, which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service, and guarantees.

We will take all reasonable care to ensure that all details, descriptions, and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy. While we make every effort to portray colours correctly, we cannot guarantee that the colours on the Website are accurate. If you require a close colour match we will be happy to select matching zips, thread, bias bindings, and linings, if you supply a sample of your fabric. Samples are available on request; up to five samples can be requested free of charge.

Delivery

Depending on the size and weight of your parcel will use one of the following delivery services: Royal Mail, MyHermes, Parcel Force, or APC Couriers.

Orders placed before the despatch deadline on a working day are despatched the same day, subject to receipt of payment and available stock. We reserve the right to change the despatch deadline from time to time. The despatch deadline for the day is displayed at the checkout when you choose your method of delivery. If we do not have sufficient stock to fulfil your order we will ship the available items and include a notification of part shipment with your order, detailing the shortfall and when you can expect to receive the balance of your order. You will not incur any additional shipping charges for goods which are part shipped due to insufficient stock.

All delivery times are estimates. In any event we agree to delivery your order no later than 30 days after the day on which you placed the order, unless we have notified you otherwise, or unless we have notified you that we do not accept your order, or you have cancelled your order in accordance with our cancellation policy. We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

At present we only ship to addresses in the United Kingdom.

Please choose the delivery option relevant to your geographical location. If you select the incorrect option this may delay despatch of your order while we contact you for payment of additional postage costs.

Our delivery charges are calculated by weight, with the exception of oversized items (over 60cm); here we use a volumetric weight to determine the delivery charge.

If your order is small enough to ship by Royal Mail as a large letter (35cm long x 25cm wide x 2.5cm deep) we will issue you with a £1.50 voucher to use on your next order.

Cancel or change an order

We’re sorry that in most circumstances it’s not possible to make changes to your order once you’ve placed it.

If you’d like to add products to your order, please place a new order for these items.

If your order has already been despatched or delivered, then you’ll need to follow our Returns procedure in the event of any unwanted products.

Track your order

To check your order status, just click on the ‘My Account’ link at the top of the page, sign in and then from the order history select ‘view’ to see the details of the particular order.

The order has been sent to Tailor Mouse. This means we have been notified of your order but it hasn’t been processed yet.

An invoice for payment has been issued. This is the order acknowledgement you receive after payment has been made.

A Payment has been received. This means that we have been notified of your payment by Paypal or WorldPay

The order has been despatched. This means that your order has been despatched in the post or by courier.

The order has been cancelled. This means your order has been cancelled by either you or us.

If you cancel an order, or return goods for a refund, your order will be updated to notify you of the progress. If you have opted to receive email notifications at the time you placed the order, you will automatically receive an email notifying of the update, together with a link to your account to view the order.

Missing, incomplete or damaged orders

If your order hasn't arrived please sign into Your Orders here to check that your order has been despatched.

If your order has not arrived in the estimated delivery time quoted on the order acknowledgement, contact us immediately. Claims for items delayed/lost on a next day delivery service must be made within two days of the despatch date. Customer Services, or telephone 01423 819425, Monday – Friday 9am – 5pm.

Items shipped on our saver service and first class service are only considered missing after 15 working days from the date of posting. Items shipped on our next day service are only considered missing after 10 working days from the date of posting. If Royal Mail, Hermes, Parcel Force or APC Couriers are unable to deliver your parcel you will receive a card notifying you of an attempted delivery. You will be responsible for arranging an alternative delivery date or collection from the depot.

If your order hasn’t arrived we will only issue a replacement after the relevant time period has elapsed, these are as follows:

  • 1st Class – 16 working days after the item was posted
  • Saver Service – 16 working days after the item was posted
  • Next Day Service – 11 working days after the items was posted

We will ship your order to the shipping address you provide on our Website at the time you place your order. If you provide an incomplete or inaccurate address we cannot be held responsible for items delayed or lost in the post. In these circumstances you will not be eligible for a refund or replacement.

If your order arrives incomplete check the parcel for a part shipment notification, this will detail any items which we did not ship due to stock shortages. If you don’t have a part shipment notification, and items are missing please check the packaging carefully, small items can easily be discarded with packaging. We snap shot orders before they are packed, so we can check what was shipped. If we have missed something from your order please email our Customer Services

If your order arrives and the goods are damaged please call us immediately on 01423 819 425 between 9am and 5pm Monday to Friday, excluding bank holidays, or email Customer Services

Before we can process a refund, or issue a replacement for items damaged in transit, you will be required to provide photographic evidence of the damaged item and the packaging as it was received, or, we may ask you to return to us the damaged goods, including the original packaging. If we ask you to return the damaged goods we will provide you with a postage paid label for the most cost effective delivery service. We will process your refund or issue a replacement item, subject to availability, within 10 days of receiving your damaged goods, or receiving photographic evidence of the damaged goods and associated packaging.

Returns procedure

The order number, stock number, the reason for the return.

If you are returning an item damaged in transit we will provide you with a postage paid label for the most cost effective delivery service.

Royal Mail 2nd class Small Parcel – Items not exceeding 2kg, 45cm (L), 35cm (W), 16cm (D)

MyHermes – All items over 2kg – Max weight 15kg, max length 120cm, max volume 225cm. To calculate the volume, add the two shortest lengths together and multiply by 2, then add the length.

If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

Refund policy

We want you to be happy with your purchase. If you're not, just return the product to us following the instructions above, and we'll issue a refund.

Under Consumer Contracts Regulations 2013, if you buy online or by phone, your consumer rights entitle you to a full refund if you request one in writing within 14 days of receipt. This includes the cost of delivery, (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery), but excluded the products listed as exceptions below:

Personalised or made-to-measure products, this includes fabrics, trimmings, and other items cut to size, including cut items which you have asked us to colour match.

The refund

We can only make a refund to the original debit, credit or charge card used for the purchase.

Condition of returns

It's important that returned items are in the best possible condition, so please take reasonable care of them. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

Delivery charges

We will refund any standard delivery charges you've paid, provided you return the full order. If we shipped your parcel at a cheaper rate of postage than you originally paid, and we have subsequently issued a refund for overpaid postage we will refund you the amount you originally paid less any refund you have already received. Next day delivery is an additional service and is not refundable, however we will refund the amount you would have paid for standard delivery saver service.

We’re unable to cancel, refund, or exchange, unless faulty, or not as described, the following products:

Items which have been specifically ordered for you, personalised or made-to-measure products, this includes fabrics, trimmings, and other items cut to size, including cut items which you have asked us to colour match.

General

Intellectual property and right to use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Compliance with laws

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or

any loss of goodwill or reputation; or

any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Severance

If any part of the Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what Tailor Mouse Ltd and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Law

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
